The initial phase of the pilot scheme in relation to winding up cases in the Company and Bankruptcy List, which operated from 1 October 2008 to 30 September 2009, has already finished on 30 September 2009. According to the Practice Direction 3.3A which comes into effect on 1 October 2009, the pilot scheme is extended for 3 months from 1 October 2009 to 31 December 2009. The scheme is to encourage the parties in company and bankruptcy List to consider the use to mediation as a possible additional means of resolving their disputes in a cost-effective and more expeditious manner. Practice Direction 3.3 paragraph 18 provides that for the purposes of evaluating the effectiveness of the pilot scheme, the parties or their legal representatives are requested to report the effectiveness to the Clerk to the Judge in charge of the Companies and Bankruptcy List within 28 days of the conclusion of the court proceedings.
